Fish & Richardson Receives Accolades in China for ITC Win in JK Sucralose Patent Case
BEIJING--(Marketwire), 24 June 2009 -- Fish & Richardson received accolades at a global press conference in Beijing for its International Trade Commission (ITC) win on behalf of JK Sucralose, Inc. The press conference was organized by JK Sucralose, Inc. -- and featured a speech by Dr. Gu Quiangsheng, Mayor of Sheyang Country, Jiangsu Province -- to celebrate the ITC's ruling on April 7, 2009 that JK Sucralose does not infringe U.S. Patent Number 4,980,463 asserted by British sugar company Tate & Lyle PLC.
Tate & Lyle PLC, which markets sucralose sweetener under the name Splenda®, initially filed a complaint with the ITC against three Chinese manufacturers of sucralose and 18 companies that imported sucralose or distributed it in the U.S. JK Sucralose successfully intervened in the ITC investigation on August 15, 2007 to defend its own sucralose manufacturing process and product. JK Sucralose's ITC win marks the first time that a Chinese company has intervened in and won a U.S. ITC 337 investigation.
"This was a complete victory for JK Sucralose. We persuaded the ITC that JK Sucralose's manufacturing process did not infringe the asserted patent and that the patent was invalid," said Craig Smith, a principal at Fish & Richardson.
