IneoQuest Files Complaint Against Ixia for Illegally Acquiring Its Award-Winning Video Monitoring Te
Ixia Allegedly Violates Written Non-Disclosure Agreement and Other Obligations
MANSFIELD, MA--(Marketwire), 3 December 2008 -- IneoQuest Technologies, Inc., the leading global supplier of end-to-end video quality, service and revenue assurance solutions, today announced that it had filed a complaint against Ixia, in the United States District Court for the Central District of California. In the complaint, IneoQuest states that Ixia knowingly misappropriated from IneoQuest the technological basis for Ixia's current video test and measurement solutions. The complaint alleges that Ixia and IneoQuest entered into a written non-disclosure agreement (NDA) in 2004 to allow the parties to discuss possible business and technical relationships. During this period, Ixia allegedly obtained valuable technology, market and company information from IneoQuest under the NDA. Moreover, well after Ixia had decided not to include IneoQuest in its video development plans, Ixia continued to obtain valuable information from IneoQuest under this NDA, and under a "no-shop" term sheet. Ixia then allegedly used the obtained IneoQuest information as the core for the video solutions it currently purports to market. The complaint further alleges that Ixia has illegally interfered with IneoQuest's business by spreading false information to influence customers' purchasing decisions, and to obtain other illegal advantages in the market.
